FIRSTRAND BANK LTD, Judgment Creditor, and GREGORY DEANE SPILLER, Judgment Debtor – NOTICE OF SALE IN EXECUTION

In execution of a judgment of the High Court of South Africa (KwaZulu-Natal Division, Pietermaritzburg) in the abovementioned suit, a sale without reserve will be held at 17A Mgazi Avenue, Umtentweni, on 15 December 2014 at 10h00, of the undermentioned property of the Execution Debtor on the conditions which may be inspected at Sheriff’s Office, 17A Mgazi Avenue, Umtentweni, prior to the sale. Certain: Erf 516, Margate Extension 1 Township, Registration Division ET, Province of KwaZulu-Natal, being 22 Valley Road, Margate Extension 1, measuring 2 225 (two thousand two hundred and twenty-five) square metres, held under Deed of Transfer No. T028718/2007.
The following information is furnished re the improvements, though in this respect nothing is guaranteed and no warranties are given in respect thereof. It is the buyers’ responsibility to verify what is contained herein. Main building: Vacant stand. The sale shall be subject to the terms and conditions of the High Court and the Rules made thereunder and the Purchaser (other than the Execution Creditor) shall pay a deposit of 10% of the purchase price and auctioneer’s commission plus VAT thereon in cash by bank-guaranteed cheque or via EFT at the time of the sale. 1. This sale is a sale in execution pursuant to a judgment obtained in the above Court on 24-02-2014.
2. The Rules of this Auction are available 24 hours before the auction at the office of the Sheriff, Port Shepstone at 17A Mgazi Avenue, Umtentweni, during office hours.
3. Registration as a buyer is a pre-requisite subject to conditions, inter alia (Registration will close at 10:00 am):
(a) In accordance to the Consumer Protection Act 68 of 2008 (http://www.info.gov.za/view/downloadfileAction?id=99961);
(b) FICA—legislation i.r.o. proof of identity and address;
(c) Payment of a registration fee of R10 000,00 in cash;
